Yes - although in some cases the court can penailise a party for refusing to mediate.
The appointment of a mediator will be agreed by all parties in dispute.
No. Any resolution of the dispute can only be by agreement between the parties.

Usually the mediator will have a template, which will be amended to reflect the terms agreed. This is not obligatory and the agreement can be drafted by lawyers if preferrred.
Yes. We would always try and encourage some joint participation, however it is recognised that sometimes this may not be possible.
