There is a popular misconception that mediators should have a legal background, which is not accurate. A mediator should however have a good working knowledge of the legal system and above all an experienced understanding of how justice is determined by the courts, which is often profoundly different to what you may expect.

What makes an effective mediator

PDR believes that an effective mediator should have had experience successfully owning and running business's. No amount of professional training can compensate for first hand transactional experience,  responding to exceptional challenges and ensuring a business is best in class and competitive.


  


Mediation is a people pathway

Parties in dispute are advised by lawyers as to the merits of their legal case, in the context of a judicial process that will end at trial.  Finding a solution at mediation requires a different pathway that begins with an understanding of the key protagonsists and their commercial perspective. Often these are high achievers, who are very adept at negotiation and getting their own way.
